General terms and conditions

1. Scope

These terms apply to the use of Noodle (Noodle Book, Noodle Chat, Noodle Card and related services) provided by Bark and Beauty AG, Moosstrasse 35, 8134 Adliswil, Switzerland (UID CHE-251.390.557; “we”). Noodle is made for businesses. Anyone who opens an account for a business confirms that they are authorised to represent it.

2. Services

  • Noodle Book: online booking, calendar, payments through the business's own Payrexx account, invoices, reminders and customer accounts.
  • Noodle Chat: WhatsApp through the official WhatsApp Business Platform, a shared inbox, templates, broadcasts and AI reply suggestions.
  • Noodle Card: customer records with your own fields and objects, notes, tasks and AI summaries.

For Noodle Chat you connect your own WhatsApp Business account; WhatsApp's terms also apply to it. Your customers' online payments run through your own Payrexx account, and automations, if you want them, through Zapier – each under your own contract.

The scope of each plan is described on the pricing page at the time you sign up. We keep developing Noodle and may change features as long as the agreed core of the service remains. We give notice of significant changes in advance.

3. Account

The account requires correct details: company name, billing address and UID. You are responsible for your team's access and for the activity in your account, and you report any misuse to us immediately.

4. Trial

  • The trial lasts 14 days, once per company.
  • To start, you add a credit card. Payrexx holds CHF 0.10 as a check; the amount isn't charged, and your bank releases it.
  • We remind you three days before the trial ends.
  • If you cancel before the trial ends, there are no costs. Otherwise the subscription starts automatically with the plan and billing period you chose.

5. Prices and payment

  • The prices on the pricing page at the time you sign up apply, in Swiss francs.
  • We bill in advance: monthly or for one year. Payment is by credit card through Payrexx.
  • A move to a bigger plan applies immediately; the difference for the current period is charged pro rata. A move to a smaller plan applies from the next period.
  • Team members, contacts and messages are included volumes: at 80% and 100% we notify you and suggest a suitable plan. API calls, broadcasts, WhatsApp numbers, teams and AI requests are limited per plan.
  • We announce price changes at least 30 days in advance.
  • If a payment that is due can't be collected, we may suspend access after a reminder.

Third-party fees aren't included in the price, in particular the fees of your Payrexx account and WhatsApp's fees for certain messages.

6. Cancellation

You can cancel at any time, effective at the end of the current period, in the settings or by email to support@noodlebx.com. Periods already paid aren't refunded unless the law requires it. We may terminate for good cause, for example in the event of a serious breach of these terms or late payment.

7. Use

You use Noodle only lawfully. In particular, you follow WhatsApp's rules for business messages and obtain the necessary consent from your customers, for example for reminders and broadcasts. No spam, no access to other people's data, no attacks on Noodle.

8. Data

The data you record in Noodle belongs to you. We process your customers' data only on your behalf and only to provide Noodle. Details are in the privacy policy. You can get a copy of all your business's data by writing to support@noodlebx.com, also after the contract ends. After the contract ends, we delete the data within 30 days, unless we're required to keep it.

9. Availability

We operate Noodle with care and aim for high availability. Where possible, we schedule maintenance outside usual business hours. We can't guarantee uninterrupted operation, in particular not during disruptions at providers such as WhatsApp, Payrexx or AWS.

10. Liability

We are liable for damage we cause intentionally or through gross negligence. Otherwise, to the extent permitted by law, our liability is excluded, in particular for indirect damage and lost profit, and is limited to the fees for the three months before the event that caused the damage.

11. Changes to these terms

We may change these terms. We announce significant changes by email at least 30 days in advance. If you don't agree, you can cancel with effect from the date the change takes effect.

12. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is Zurich.
